This page (together with the documents expressly referred to on it) tells you information about Source BioScience UK Limited ("We", "Us" and "Our") and the terms and conditions (Terms) on which We will supply the sexually transmitted infection ("STI") testing services (Services) advertised on Our website (Our site).
No contract exists between you and Us for the provision of the Services. The Services are provided to you free of charge.
Please read these Terms carefully and make sure that you understand them, before ordering Services through Our site. These Terms explain the basis on which we will provide the Services to you.
1.1 We operate the website www.dontpassiton.co.uk. We are Source Bioscience UK Limited, a company registered in England and Wales under company number 4078501 and with Our registered office at 1 Orchard Place, Nottingham Business Park, Nottingham, NG8 6PX. Our VAT number is 813 6499 14.

1.3 Our laboratories are CPA accredited (reference number: 0889).
4.1 You may only order Services from Our site if you are at least 16 years old.
4.2 We require the following from you in order that We may provide you with Our Services:- Title, first name, last name, email address, house/flat number, street address, city and postcode, gender, date of birth and country of birth.
5.1 To place an order on Our site, you will need to:
(a) order a STI testing kit;
(b) enter the necessary details to enable Us to provide the Services, including providing an email address and selecting your preferred method of contact.
5.2 Please make sure that all information submitted during the order process is correct. You will not be able to amend any errors once you reach the payment stage. Please, therefore, take the time to read and check your order at each page of the order process.
5.3 After you place an order, you will receive: (i) an e-mail from Us acknowledging that We have received your order; and (ii) an email and/or SMS (text message) and an access key within an information leaflet with the STI testing kit. This will provide you with details of how to access to your results.
5.4 We will then, as soon as practicable, dispatch an STI testing kit to you. We will confirm that the STI testing kit has been dispatched to you via the contact method selected by you (i.e. email, SMS or both) during the order process.
5.5 If We are unable to supply Services to you, We will inform you of this by e-mail.
6.1 Following your order on Our site, We will send a STI testing kit by first class post to the address provided by you. We will endeavour to deliver the STI testing kit to you within five (5) working days of the date of your order but We cannot accept any liability for any delay in the delivery of the STI testing kit to you.
6.2 If you have not received a STI testing kit within five (5) working days of the date of your order, please re-visit Our site and place a second order in accordance with the instructions. If you still do not receive a STI testing kit 5 working days from the second order being placed, contact Us at email@example.com.
6.3 Following receipt of the STI testing kit, you should follow the instruction enclosed with the STI testing kit, and return the test pack to Us as soon as possible in the packaging provided.
6.4 In the unlikely event that there is a defect with the STI testing kit, please contact Us immediately at firstname.lastname@example.org and We will send a new STI testing kit. The defective testing kit should also be returned to Us by post using the packaging provided.
7.1 We will test the sample that you have returned to Us (i.e. supply the Services) as soon as reasonably practicable following receipt of your sample.
7.2 We will endeavour to test your sample within ten (10) working days of receipt (but in most cases expect timescales for completion of testing to be shorter), however We will not be obliged to supply the Services by any specific date or deadline, and there may be delays due to an event outside our control. We will not be liable in any way for any failure to perform, or any delay in the performance of, the Services due to an event outside our control.
7.3 We will not be able to provide the Services in the event that:
(a) you fail to return the testing kit to Us;
(b) there is a problem with the sample provided by you; and/or
(c) there is a problem with extracting information (i.e. DNA) from the sample that you have provided, which is essential to the provision of the Services.
7.4 If We are able to provide the Services We will notify you that your results are ready by the contact method that you selected. Your results will be made available to you securely on Our site with your access key.
7.5 If We are unable to provide the Services We will notify you by the contact method you have selected (i.e. email, SMS or both). You will then need to re-visit Our site and place a further order in accordance with the instructions.
8.1 The Services are provided to you free of charge and we therefore, subject to clause 8.2, exclude all liability to you of any kind.
8.2 We do not in any way exclude or limit Our liability for:
(a) death or personal injury caused by Our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any other matter which it would be unlawful for Us to exclude or redirect liability.
8.3 We only supply the Services to you for your own private use. You agree not to use the Services for any commercial, business or re-sale purposes, and We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9.1 When We refer, in these Terms, to "in writing", this will include e-mail.
9.2 If you wish to contact Us in writing for any other reason, you can send this to Us by e-mail or by pre-paid post to Source Bioscience UK Limited at 1 Orchard Place, Nottingham Business Park, Nottingham, NG8 6PX or email@example.com.
9.3 If We have to contact you or give you notice in writing, We will do so by e-mail or by post to the address you provided to Us in your order.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Please note that these Terms are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may bring proceedings in Scotland.
